It was the first time that a painting generated via an AI algorithm reached the world auction stage. The Portrait is not the first product of an algorithm that is  classified as art. It was preceded by Tresset's art painting robot and Weinberg's marimba playing robot improvising jazz, to name a few. As art is regarded as a unique manifestation of human creativity, the question of algorithmic creativity arises: Can technologies be considered creative? Or more broadly, can they constitute synthetic personhood? In my talk I will examine whether these works can be considered as art and what is the place of the human creativity in this process. My starting point is rooted in philosophy in which imagination is conceived as a unique human faculty yet required for most of our actions in the world. I will show how Kant's definition of productive imagination is a basic element of creativity, and yet it is implemented in various AI algorithms to recognize faces or identify objects in an image. The end point of the talk is a co-shaping model in which humans and their technologies shape each other. This model would enable us to bypass the difficult questions of copyright in machine-created works of art, whether to grant the right to free expression to machines, and the like.
